These Terms of Service ("Terms") govern your use of our website at [www.oluskitchen.com] and your purchase of food and catering services from us. By placing an order or using our website, you agree to these Terms. If you do not agree, please do not use our website or place an order.

These Terms should be read alongside our Refund & Cancellation Policy, Shipping Policy, and Privacy Policy, which form part of our agreement with you.

2. Our Products & Services

We offer:
- Standard food orders — freshly prepared meals for individual delivery or collection, ordered through our website.
- Private event & catering bookings — bespoke catering for private events, subject to a booking deposit and separate cancellation terms.

Photographs of dishes are for illustration only; actual presentation, garnish, and packaging may vary. Ingredient availability may occasionally require substitution of a comparable item — we will let you know if this affects any allergen information relevant to your order.


3. Placing an Order

- Orders are placed through our website and are subject to acceptance by us. A contract is formed when we send you an order confirmation, not when you submit your order. We may decline or cancel an order (e.g. due to stock issues, delivery area restrictions, or a pricing error), in which case you will receive a full refund of any payment taken.
- You must provide accurate ordering, delivery, and contact information, including any allergen or dietary requirements. We are not responsible for issues arising from inaccurate information you provide.
- You must be at least 18 years old to place an order with us. 

 

4. Pricing & Payment

- All prices are shown in GBP (£).
- We take reasonable care to ensure prices are correct but reserve the right to correct genuine pricing errors before your order is confirmed.
- Payment is taken in full at the time of ordering [or: a deposit is taken at the time of booking for private events — see our Refund & Cancellation Policy].
- We accept payment via debit/credit card, Apple Pay, processed securely by our payment provider [Wix payments].


5. Delivery & Postage

Delivery is provided in line with our Shipping Policy, which sets out delivery areas, timeframes, and charges, including free delivery on orders over £100.


6. Cancellations, Refunds & Food Safety

Cancellations and refunds are governed by our Refund & Cancellation Policy. In summary:
- Freshly prepared, made-to-order food is exempt from the standard 14-day cooling-off right under the Consumer Contracts Regulations 2013.
- You have rights under the Consumer Rights Act 2015 if your order is faulty, unsafe, incorrect, or not as described.
- Nothing in these Terms limits your statutory rights as a consumer.


7. Allergens & Dietary Information

Allergen information for each dish is provided on our website and/or on packaging. It is your responsibility to check this information before ordering and before eating, particularly if you have a food allergy or intolerance. Please contact us before ordering if you have any doubt about an ingredient. We take reasonable care to prevent cross-contamination but cannot guarantee any product is completely free of trace allergens, as our kitchen handles multiple allergens.


8. Your Account

If you create an account with us, you are responsible for keeping your login details confidential and for all activity under your account. Please tell us immediately if you believe your account has been used without your permission.


9. Acceptable Use of Our Website

You agree not to:
- use our website for any unlawful purpose or in a way that could damage, disable, or impair it;
- attempt to gain unauthorised access to our systems or another user's account;
- submit false, misleading, or fraudulent information when placing an order.

We may suspend or terminate your access to our website or refuse to fulfil an order if we reasonably believe these Terms have been breached.


10. Intellectual Property

All content on our website — including text, recipes, photographs, logos, and branding — belongs to us or our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use this content commercially without our prior written permission.


11. Liability

Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot be excluded or limited under UK law, including your statutory rights under the Consumer Rights Act 2015.

Subject to the above, our liability to you for losses arising from your order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses (e.g. loss of enjoyment of an event), except where caused by our negligence or breach of these Terms.


12. Events Outside Our Control (Force Majeure)

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including natural disasters, pandemics, strikes, or government restrictions. Where this affects a confirmed booking, the refund terms in our Refund & Cancellation Policy apply.

14. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in law or our services. The version in force at the time you place an order will apply to that order. We recommend checking this page periodically.

We process your personal data in accordance with our Privacy Policy and applicable UK data protection law, including the UK GDPR and Data Protection Act 2018.


16. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to your right as a consumer to bring proceedings in your local court.
